DECISION ON MOTION FOR LEAVE TO APPEAL

[1] The motion for leave to appeal from the order of Lavine J. dated May 7, 2021 (unreported) is dismissed.

[2] The moving party uploaded costs submissions to CaseLines dealing with the issue of costs before the motion judge. Neither party uploaded costs outlines dealing with the costs of the motion for leave to appeal despite Corbett J.’s directive that they do so by July 7, 2021. In the circumstances, we order no costs on the motion for leave to appeal and the costs of the motion below are to be decided by the motion judge.
