[1] Peter Roscoe requested an urgent case conference to request a motion to dismiss Zeliko Ristic's appeal of a Landlord and Tenant Board decision or alternatively to request that the stay of the LTB decision be lifted.
[2] Mr. Roscoe's request was granted.
[3] The court provided Mr. Roscoe and Mr. Ristic with the date and time of the case conference (Friday, July 9. 2021 at 10 a.m.) as well as a Zoom link to the virtual court room.
[4] Mr. Ristic appeared. Mr. Roscoe did not.
[5] The court waited until 10:40 for Mr. Roscoe to appear. The registrar then informed Mr. Ristic that the matter would not be proceeding.
[6] Court time is valuable and scarce, particularly during the summer months. Mr. Roscoe was offered a case conference by the court based on his representations that this matter was urgent. If Mr. Roscoe wishes to request another appointment, he shall explain why he did not attend today.
