ENDORSEMENT
[1] Toronto Community & Culture Centre’s motion for leave to appeal the Assessment Review Board’s decision of March 30, 2020 and review decision of August 13, 2020 is granted. The issue of law on which the appeal is granted is whether the Board breached the moving party’s procedural fairness rights.
[2] The moving party is to contact the Divisional Court within 14 days of the release of this decision to request a case conference with Favreau J. for the purpose of scheduling the appeal.
[3] The Respondent and the Assessment Review Board took no position on the motion. An order for no costs is appropriate in the circumstances.
