[2] The appellant advised the respondent by email earlier this year that she does not intend to pursue this appeal. She confirmed this position today.

[3] On consent the appeal is dismissed. The respondent asked for costs. While I accept that some time was involved in bringing this before the court, the appeal was never perfected and the respondent never filed a factum or responding materials. There shall be no order for costs.
