[1] Leave to appeal to the Divisional Court was granted on September 18, 2020 (Varcoe v. Varcoe, 2020 ONSC 5587, per Aston, Sachs and Kristjanson JJ.). The leave panel directed that the appeal be expedited.
[2] The issues for appeal directed by the leave panel are as follows:
(a) The schedule and hearing of the moving party’s recusal motion; and
(b) The scheduling and hearing of the outstanding motion of the Office of the Children’s Lawyer and any further motion it may initiate before the appeal is heard
[3] Mr Adair’s client shall serve the appeal record and factum by October 6, 2020. The OCL shall serve its record and factum by October 13, 2020. The respondent, Ms Bevan, shall serve her responding record and factum by October 23, 2020. The appeal shall be heard by Zoom videoconference on November 3, 2020, 10:00 am, by a panel of three judges of the Divisional Court, for an estimated 2.0 hours.
[4] Mr Adair’s firm shall provide a file sharing platform into which all materials shall be placed. The link and password for this platform shall be provided to the court by October 23, 2020.
[5] I have explained to the parties that the appeal is restricted to the questions stated by the appeal panel. The issues on appeal are whether certain steps should be scheduled and heard by the court below, and not the question of how the merits of those proposed motions ought to be decided.
[6] As discussed during the teleconference, service shall be effective by email and the court will not require the parties in this case to provide affidavits of service: evidence of service will be established sufficiently by placement of documents in the file sharing platform.
