CASE MANAGEMENT ENDORSEMENT
[1] This motion for leave to appeal from the LPAT decision dated July 22, 2020, shall be heard by Mew J., sitting as a single judge of the Divisional Court, by Zoom videoconference, on October 26, 2020, for 2.0 hours. The court will provide the parties with the link to the videoconference in due course by email.
[2] The moving parties’ motion materials shall be served by October 2, 2020. The responding party’s materials shall be served by October 19, 2020.
[3] All materials shall be in pdf format. Factums should also be in Word format. Parties may (but are not required to) file factum compendiums and compendiums for oral argument. Costs materials and counsel sheets must be filed. Counsel for the moving parties shall establish a file sharing platform for all motion materials and shall provide the link and password to that platform to the court by 12 noon on October 19, 2020.
[4] Any issues that arise with scheduling may be addressed back before this court or with Mew J. or as His Honour directs.
[5] As usual, the Tribunal did not appear on the conference respecting this motion for leave to appeal. If leave is granted, counsel for LPAT should be given notice of any teleconference for scheduling steps in the appeal.
[6] If leave to appeal is granted then the parties shall (a) try to agree on a schedule for exchange of appeal materials and scheduling of a return date for the appeal; and (b) forward their agreed schedule to the court for approval or, if the schedule cannot be agreed, schedule a case management teleconference with an administrative judge of the Divisional Court. These steps should be completed within two weeks of a decision granting leave to appeal.
