[1] The appellant appeals a decision of the HPARB dismissing his appeal from a decision of the ICRC, declining to investigate complaints made against a number of doctors. Both the ICRC and the HPARB dismissed the applicant’s claims summarily. The ICRC dismissal was on the basis that “the allegations are essentially incapable of proof and are not credible”, that “[t]here is no information to support the … claims” and “[i]t appears likely… that the Complainant’s claims are related to faulty perceptions and a withdrawal from reality.” The HPARB dismissed the applicant’s appeal from the ICRC as frivolous, vexatious and an abuse of process, essentially for the reasons given by the ICRC.
[2] This court does not have the record that was before the ICRC and the HPARB. Nonetheless, this court does have a summary of the allegations made by the Complainant set out in the decisions below which, on their face, seem to support the ICRC and HPARB decisions. The applicant’s Notice of Appeal is technically sufficient – stating generic grounds for review of the HPARB decision below – but it provides no particulars. However, a review of the allegations made by the appellant set out in the ICRC decision seems to provide a basis for the decisions below.
[3] The Registrar is directed to give the appellant notice that the court is considering dismissing this appeal pursuant to R.2.1.01 for the same reasons that it was dismissed by the ICRC and the HPARB. The appellant shall have fifteen days to provide his response to the notice. If he requires more than fifteen days to respond, he may request an extension of this deadline in writing. There is no page limit on the appellant’s submissions in response to the notice under R.2.1.01.
