CASE MANAGEMENT ENDORSEMENT
[1] This endorsement reflects a teleconference conducted August 17, 2020.
[2] Ms Stone appealed an order of the Landlord and Tenant Board in October 2019. On December 16, 2019, she filed proof that she had ordered transcripts for the appeal. The transcripts have not yet been delivered.
[3] During the teleconference the parties were in essential agreement on some facts. The tenant’s monthly rent is about $1350 per month. The tenant is in arrears by between about $7,000 and $9,000. The tenant has made some payments towards rent but has had difficulty meeting the monthly rent in full and on time. In this context, during the teleconference, the parties settled this appeal on the following basis:
(a) The appeal is dismissed without costs.
(b) Eviction of the tenant is stayed until after October 31, 2020.
(c) The tenancy is terminated effective October 31, 2020 and the landlord may seek eviction on and after November 1, 2020.
[4] An unsigned copy of this endorsement is effective upon transmission of it to the parties by Divisional Court staff by email. A signed copy will be provided to the parties in due course.
