Endorsement
[1] The tenant Lynn Malloy appeals the order of Member Kevin Lundy of the Landlord and Tenant Board dated August 4, 2020 in respect to premises known municipally as 65-595 Rymal Road East, Hamilton ON L8W 3V6.
[2] Pursuant to R.63.01(3), the said order is stayed pending determination of the tenant’s appeal, subject only to any subsequent order that may be made by the court pursuant to R.63.01(5).
[3] During the ongoing COVID-19 crisis, Divisional Court is unable to provide the tenant with a formal issued certificate of stay. This endorsement has the full authority and effect of such a certificate and the Sheriff and all other person having notice of this endorsement (including, without limitation, the landlord) are required to observe and follow this stay order as sufficient evidence of the court’s order.
[4] Any interested party may obtain confirmation from the Divisional Court that this endorsement is a genuine order of this court by email addressed to:

[5] This endorsement has been signed by D.L. Corbett J., and is effective from the time at which an unsigned copy of the decision is sent to the parties by email on August 13, 2020. A signed copy of the endorsement will be provided to the parties as soon as possible subject to the exigencies of current court operations during COVID-19.
