CASE MANAGEMENT ENDORSEMENT (IN CHAMBERS)
[1] Three matters have not been addressed in prior endorsements (2020 ONSC 2175 [April 4, 2020] and 2020 28923 [April 21, 2020]) which the court wishes to address before this case is heard on May 21st. None require a further case management conference unless counsel cannot agree on time allocations for oral argument.
[2] First, the court neglected to confirm time estimates for the hearing. The ordinary court day is about 4.5 hours (excluding breaks and lunch). The parties shall agree among themselves on the time each party and the intervenor group shall have for submissions and shall provide the court with their agreement by no later than May 8, 2020. If the parties are unable to agree on time allocations to bring the duration of the hearing within the 4.5 hour limit for a one-day hearing, then the parties shall arrange a further case management teleconference with the court.
[3] Second, the parties and the intervenor group shall file their agreement on the disposition of costs, or, if the parties have not agreed as to costs, then each party shall file its bill of costs and costs outline and any brief supporting materials relied upon in respect to costs. The court does not open costs materials until the conclusion of the hearing.
[4] Third, each party and the intervenor group shall file a counsel sheet setting out the name(s) of all counsel appearing at the hearing and their estimated time for submissions.
[5] Costs materials and counsel sheets may be filed at the same time as the compendiums for oral argument are filed.
[6] One matter arises out of my case management endorsement of April 21, 2020: portions of that endorsement (2020 28923) include unintended repetition and the endorsement did not include a neutral citation. An amended endorsement will be released shortly to the parties rectifying these errors; the substance of the direction will not be changed by these directions.
[7] The court has endorsed its fiat on this endorsement this day; the unsigned version distributed to the parties today has the authority and effect of the signed version, a copy of which will be provided to the parties in due course after the suspension of ordinary court operations is lifted.
