COSTS ENDORSEMENT

[1] On May 14, 2019, I dismissed the applicant’s motion for release of an audio recording of a motion and her request to strike a certain reference in the affidavit of Ruth Wellen. I reserved on the issue of costs. The respondents who were represented by John No, a staff lawyer at Parkdale Community Legal Services, seek costs of $500 each.

[2] In support of her submission that there be no order as to costs, the applicant submits that John No is an assumed name and there is no support for the amount sought by way of time docket, hourly rate or disbursements.

[3] John No appeared on the motion. The respondents were the successful parties. The amounts requested are nominal and are in keeping with the modest amounts at issue in the underlying Small Claims Court actions. In my view the amounts requested are appropriate. The applicant is ordered to pay costs of $500 to each of the respondents, Holly Loggie and Goran Hinic.
