[1] The applicant/tenant moves to vary the order of Mr. Justice Then, who set down conditions regarding the appeal by the tenant. The conditions were: to pay the arrears of rent and to pay rent until the appeal is heard.
[2] Mr. Weidenfeld has not paid any arrears. On March 6, 2003, Mr. Justice Then dismissed the appeal for non-compliance with his order. Today, Mr. Weidenfeld, when asked, still refuses to pay anything regarding the arrears which he agrees are owing. We see no merit in this motion and it is dismissed.
[3] After consulting my colleagues, I have continued the endorsement: "The costs of this motion, payable forthwith by Mr. Weidenfeld to the Landlord, are in the sum of $350.00."
