We are all of the view that the reasons for the judgement of the Court of Appeal in C.N.A. v. Orillia Soldiers Memorial Hospital, et al conclusively determines the issues in the appeal as to liability in favour of the appellant. The appeal is allowed. The decision of the Board is set aside, and the complainant of Brad Thomson is dismissed. The appellant is entitled to its costs of this appeal, hereby fixed at $3,000, to be paid by the commission.*
