The applicants, neighbours of the respondent's swine farm, complained about odours emanating from the barn, manure storage, and manure spreading practices.
The Normal Farm Practices Protection Board found that the construction and operation of the barn and manure storage conformed to normal farm practices.
However, the Board determined that the respondent's practices of spreading liquid swine manure within a few feet of a neighbouring building and failing to till the manure into the ground when spread within 300 metres of neighbouring homes did not constitute normal farm practices.
The Board ordered the respondent to cease spreading manure within 20 metres of neighbouring buildings and to till manure into the ground as soon as practicable when spread between 20 and 300 metres of a neighbouring home.
