Introduction

[1] The defendants are the editor and publisher of a community newspaper, Your Ward News (YWN), which is distributed to over 300,000 homes centred in the Beaches neighbourhood of Toronto. It also is available on-line with a readership claim exceeding one million. They are charged under s. 319(2) of the Criminal Code with two counts of wilful promotion of hatred against an identifiable group – Jews and women. Both defendants admitted in an Agreed Statement of Facts (Exhibit 1) that these two groups meet the definition of “identifiable groups” under s. 319(7). It was also admitted that Mr. St. Germaine, as publisher, is aware of the publication’s content and distribution. All 22 issues of YWN published between January 2015 and Summer 2018 were filed as Exhibit 2.

[2] The Crown called two expert witnesses, Dr. Derek Penslar, a professor of history, and Professor Janine Benedet, a law professor. The defence conceded that both could be qualified as experts. I am grateful to counsel for their sensible concessions which greatly reduced the length of the trial. The defendants did not testify and called no evidence. Mr. St. Germaine gave a statement to police which was conceded as voluntary. The issues were reduced to whether or not the content of YWN rose to the level of hatred, and, if it did, whether or not the defendants wilfully promoted that hatred. It was conceded that the law allows for the concept of wilful blindness to provide a foundation for criminal liability. The Crown is not required to prove that any actual harm was caused by the prohibited communication.

[3] Both defendants submitted that any comments expressed in YWN must be viewed contextually. When all 22 issues are examined, one is left with unfocused and absurd opinions, contradictory messages, and scattershot ramblings. Except for its stated claims of being the world’s largest anti-Marxist publication, YWN exhibits no unifying concept. The paper, they argue, uses satire and comical images to portray views that many would consider to be highly offensive, but that those views fall short of hate promotion. One argument contends that the need to employ experts by the Crown, in and of itself, recognizes the obscurity of the material.

[4] Given the above submission, I think it is important to deal with the evidence of both experts at this point. I will first say that both were extremely impressive. They both provided the Court with a historical background to many issues written about in YWN. They both communicated their opinions regarding anti-Semitism and misogyny succinctly and authoritatively. More impressively, they both enhanced the strength of their opinions by responding thoughtfully to questions and challenges in cross-examination. I had no trouble accepting either expert’s evidence. As helpful and impressive as they turned out to be, in my view, they were not necessary. The agreed statement of facts (Exhibit 1), Mr. St. Germaine’s police statement (Exhibit 18), and Exhibit 2 (the 22 issues of YWN) provide a complete factual foundation for my analysis.

[5] The defendants took the position that YWN is primarily anti-Marxist. I agree with that assessment. That is a unifying theme, especially in the earlier editions where the focus seems to be on attacking left-wing politicians. I also accept that while a listing of excerpts of alleged examples of hate, as provided by the Crown in closing submissions, is helpful, the whole body of each issue must be examined. Since the excerpts were expansive, I will append them as Appendix A (with correction notes) to this judgment.

Prior Discreditable Conduct

[6] In late August, the Crown made application that evidence of prior discreditable conduct regarding Mr. Sears ought to be admitted in this trial. I ruled, a few weeks later, that the following evidence would be admitted into the trial record (and made Exhibit 17):

• two convictions for sexual assault in 1991;
• a medical licence revocation hearing before the Discipline Committee of the College of Physicians and Surgeons in 1992, wherein the defendant’s licence to practice medicine was revoked;
• screenshots of Dimitri the Lover’s website, tweets and blog article.

[7] I concluded that the probative value on the issue of intent outweighed the minimal prejudicial effect regarding the above three categories of evidence. I, however, excluded police occurrence reports regarding alleged inappropriate conduct as not relevant or probative. I can now say, at the conclusion of this trial, that none of that evidence factored into my decision, since, in my view, there was abundant evidence regarding Mr. Sears’ intent available in Exhibit 2 without referencing his prior conduct.

Is this hate or simply distasteful expression?

[8] In the seminal case of R. v. Keegstra, 1990 CanLII 24 (SCC), [1990] S.C.J. No. 131, the constitutionality of the hate speech provisions of the Criminal Code was at issue. The Supreme Court of Canada ruled that these laws did violate freedom of expression (s. 2 of the Charter) but were saved by s. 1 as being a limitation necessary in a free and democratic society.

[9] In the analysis, the Court examined the objective of s. 319(2). Only if there are pressing and substantial concerns can the legislative limits on a Charter right be permissible. In 1965, the Cohen Committee noted that hate propaganda not only denigrated and humiliated, and thereby caused harm to, the target group but, also, that it could attract adherents with the attendant result of discrimination, and perhaps violence, against minority groups in Canada.

[10] In Keegstra, Chief Justice Dickson wrote at paragraph 116, “Noting the purpose of s. 319(2), in my opinion the term “hatred” connotes emotion of an intense and extreme nature that is clearly associated with vilification and detestation.” He later writes in the same paragraph that hatred “implies that those individuals are to be despised, scorned, denied respect and made subject to ill-treatment on the basis of group affiliation.”

[11] After considering the entirety of Exhibit 2, a consistent and obvious theme that radiated from this publication was hatred. It was at times contradictory in that love was professed to Jews and some women. It was at times satirical in that humour and exaggeration were employed to make the point. But hatred of Jews and women was overwhelmingly the message.

[12] As noted above, a contextual approach to the views expressed in YWN is necessary. However, there were representative examples of vilification and detestation that leapt off the page. Women were represented as immoral, inferior, and not human. Mr. Sears celebrated sexual and physical violations towards them. Jews were consistently blamed, demonized, and maligned. In my view, YWN repeatedly and consistently dehumanised Jews and women, and I conclude both men intended to publish hate. No other intent can be inferred from a complete reading of this newspaper.

[13] The preeminent concern noted a half century ago, that hate propaganda could contribute to violence, is starkly relevant today. The Toronto van attack in April 2018, the Quebec mosque attack in January 2017, and the Pittsburgh synagogue attack a few months ago, are all present day displays of extreme hatred of identifiable groups. The extent to which hate propaganda, such as that which YWN publishes, bears responsibility in these cases, is still undergoing investigation.

Examples of Hate

[14] Mr. Sears (under his pen-name Dimitri the Lover) writes it was an “insane idea” to grant women the right to vote. Women do not have the “mental faculties or temperament (sic) required to make consistently rational voting decisions…” (Spring 2017)

Most women are irrational, short-sighted, passive-aggressive traitors who cannot be trusted with a vote. That is why we keep electing charming assholes who sell us out to foreign interests, corrupt the morals of our society, and open the gates of our nation to ungrateful foreigners who seek to rape, pillage and plunder out country.

[15] Dimitri the Lover also advocates jury nullification by men becoming “lone wolf gender warriors” to allow other men to be acquitted on sexual assault trials. He cites his concerns (Fall 2016):

In a non-feminized country, no man would ever face criminal charges merely for groping a juicy ass, tugging on a pair of rip tits, or raping a woman who cockteased him incessantly. But as the FemiMarxist tide sweeps across the western world, more and more countries are adopting evolutionarily backward laws whose sole purpose is to psychologically castrate men. In most western countries today, even ravaging one’s own chattel (“raping” one’s wife) has been criminalized!

He adds later that women can lie without remorse because they lack the moral fibre of men.

[16] Bemoaning a feminized culture, where men have become “pussy-whipped fags”, Mr. Sears recalls a previous generation where “rarely a day passed by where I did not witness a man pinning his woman up against a wall by her shoulders or meting out a strategic slap” (January 2016). Referring to a Russian punk band’s protest in a Christian cathedral in Moscow in 2012, as a desecration ordered by their Jewish handlers, Mr. Sears refers to the four women as “satanic whores” and “FemiMarxist cunts that deserved the horse-whip beating they received” (February 2016).

[17] Not only are there references in YWN to the necessity of women submitting to the “natural patriarchal order” as God intended (Summer 2018), but, further, that no society can survive unless women remain men’s chattel (Summer 2017). To further illustrate the point, Mr. Sears writes that rape laws exist not to protect the woman, but her owner. If you rape a woman, you are defiling a man’s chattel – like scratching his vehicle (Summer 2017). His alter ego, Dimitri the Lover, refers to sexual assault charges as “speeding tickets on the seduction highway” (Summer 2016). He further writes that Dimitri has pinned down more women against their will than any man or diesel dyke in Canada.

[18] In the Summer 2018 edition of YWN there is a two-page article by Dimitri the Lover entitled Vax Juice + Femmo Abuse = Homicidal Recluse. Mr. Sears attempts to explain the reasons behind the terrorist attack on Yonge Street in Toronto in April 2018, which killed ten people. He writes that he learned that the perpetrator (I intentionally will not refer to him by name) was a vaccine-damaged man on the autism spectrum. Then he writes:

Now it all made sense. I guarantee you that some cruel feminist cunt set him off. Trust me on that. She and the vaccine manufacturers are just as responsible for those dead bodies as he is.

[19] Mr. Sears then writes about a “misandrous feminist ideology” that victimizes and destroys young white men in our society. These men can be assisted to avoid inevitable violence by Mr. Sears providing a safe space where they can vent their frustrations before resorting to violence. He states that YWN provides these young men an “outlet” before they turn to violence.

[20] However, in the last two paragraphs of the article, Sears places the blame on women who do not submit to the patriarchal order:

Canada and the rest of the western world is about to enter the “InCel Fight Club” era, where formerly “Lone-Wolf” InCels begin forming cells which will ultimately morph from vandalism and sophomoric havoc, to mass violence. The sooner women start treating young white men with respect, and we stop damaging our children with vaccines, the better. I am confident we can turn this situation around in one generation with minimal bloodshed. But ladies, it has to start NOW with YOU! Begin submitting to the natural Patriarchal order, and stop being so shallow and materialistic…choose men based on general health over faggish good looks; and intelligence/vocation over lifestyle thrills.

I will do my part after my “hate speech” trial ends in early December, and my time greatly frees up, by resurrecting “Toronto Real Men” meetings so that I can give men like Minassian a safe space where they can vent their frustrations before they are channeled into a violent act. What can the rest of you men do? Fight femi-Marxist ideology wherever you can. If you see a vile woman emotionally or verbally-abusing a man that is either unwilling or incapable of fighting back, step in and SHUT HER DOWN, with extreme prejudice. Only then can we rid the Earth of misandrous ideology, circumvent the dystopian future we are hurling towards, and guarantee that we resurrect our Brave Old World; one based on the natural order, as God intended.

[21] Dr. Penslar is a professor of European Jewish History at the University of Toronto and also a professor of Modern Jewish History at Harvard. Based on his review of all YWN issues published between 2015 and 2018 (Exhibit 2), he determined that this publication “espouses anti-Semitic doctrines and that both its textual and visual representations of Jews are rooted in anti-Semitic concepts with a long historical pedigree.”

YWN consistently expresses hatred of Jews via five distinct yet overlapping mechanism: 1) Expressions of revulsion against Jewish faith and its practitioners; 2) Accusations that Jews were collectively responsible for Bolshevik atrocities in the USSR; 3) Claims of Jewish conspiracies to conquer and control humanity, especially through banking and finance; 4) Demonization of the state of Israel; 5) Holocaust denial.

[22] Mr. Sears writes often about the cultural eradication of Jews in that they are misguided and could be perfected as Christians. In the Winter 2017 edition, he writes about a vision he had:

The other key element of this downloading of knowledge from the cosmos was that I learned time was of the essence to perfect the Jews, because during one of the three years that I had envisioned, “The Great Pogrom” would commence (I was not made privy as to which year). Only 144,000 Jews (about 1%) would survive because they followed their Torah TO THE LETTER and rejected the Satanic Babylonian Talmud. The only hope for the other 99% of Jews was to come to Jesus Christ.

[23] Dr. Penslar writes about historical anti-Semitic themes regarding Jews’ ritual murder of Christian youth and then consuming their blood. In the Winter 2018 edition, a collage illustrates the Prime Minister, who is being controlled by Jewish financier George Soros, drinking the blood of children (poured from a Chateaux Rothschild bottle).

[24] George Soros is illustrated as a puppeteer complete with horns and other satanic imagery.

[25] The Rothschild family is portrayed as controlling the banking system which accords with a longstanding anti-Semitic attack.

[26] Mr. Sears, consistently throughout the publication, denied the Holocaust and glorified Adolf Hitler.

Not All Jews and Not All Women

[27] Another theme the defendants submitted as evidence of the absence of proof on these charges was that the writings do not attack Jews or women as a whole group. The Talmud is characterized as a satanic book but that not all Jews are deserving of hatred because of it. In addition, it is argued in YWN that present day Jews are not responsible for the sins of their ancestors. The primary goal, stated many times, is to bring Jews to Jesus. And, in the case of women, any negative comment is directed toward feminists, and the results of feminism generally, and not to all women.

[28] I accept there are ostensibly benign views of both Jews and women expressed at times in YWN, however, when read as an entire body, Jews are often represented with satanic horns, reptilian features, drinking the blood of children, and financiers controlling the levers of power as puppeteers. There is an undeniable glorification of Adolph Hitler and extensive use of Nazi imagery. The New Constitution Party of Canada, headed by Mr. Sears, incorporates, among other things, “the heart of Chancellor Adolf Hitler”. To add to that, to continually represent the extermination of six million Jews as a “hoax”, and to specifically claim that “Nazis never slaughtered people,” and that “any deaths were unintentional” (page 19, Spring 2017) not only negate any reasonable view of history, but fosters hate towards a cultural entity that would purport such an outrageous claim, or “hoax”.

[29] Similarly, the claim that only feminists, and not all women, are labelled for scorn is contradicted by a complete examination of Exhibit 2. Any position communicated that essentially denies that an entire half of the world’s population are human beings is so outrageously reprehensible that the word “hate” is starkly inadequate. One cannot refer to people as chattel, advocating violence against them, demeaning them as inferior to men, without promoting hatred towards them.

Wilful promotion of Hatred

[30] In my view, there exists significant evidence of the promotion of that hatred which undeniably illustrates their intent to pass on to others the message of hate towards Jews and women.

[31] Firstly, YWN claims to reach 300,000 with a readership of over one million. According to Mr. St. Germaine’s statement to police, the cost of production and delivery of each issue ranges from $50,000 - $70,000. Financing is obtained through donations from entities in Canada and the United States. Mr. Sears writes in the May 2018 issue that he is “a fearless, obsessed man with VERY DEEP POCKETS who is loved and admired by MANY WEALTHY SYMPATHIZERS.” It is obvious the defendants were intent on attracting resources to spread or provide their anti-Marxist, but also anti-Semitic and misogynist, message.

[32] Secondly, there are, throughout the publication, sometimes subtle but unmistakeable calls to actions, which, in my view, not only display hatred, but promote it:

• The Summer 2018 edition speaks of the perpetrator of the April 2018 van attack in Toronto as not a terrorist but a victim of toxic vaccines, and a misandrous, feminist ideology. Mr. Sears purports to offer an alternative to mass violence by offering “incels” counselling on how to be a real man. However, women must start treating young men with respect by obeying the natural patriarchal order. Men are counselled to fight the “femi-Marxist ideology” wherever they can. “If you see a vile woman emotionally or verbally abusing a man that is either unwilling or incapable of fighting back step in and SHUT HER DOWN with extreme prejudice (my italics). Only then can we rid the Earth of misandrous ideology.” (As a side note, I recall a memorable scene at the beginning of the 1979 film Apocalypse Now. A soldier is given a mission to terminate the command of a superior who has gone insane. He is told to terminate that command, with extreme prejudice, which clearly meant, to kill him.)
• The Fall 2017 edition deals with Mr. Sears, as resident Jewologist (sic), reviewing prospects of converting Jews to Christianity. He relates a vision sent from God inspiring him to “build a spiritual ark to take Jews on a voyage of salvation.” He feels Jews to be in danger from the Alt Right: “My main goal in pointing out Jew’s crimes has been to shatter their supremacist myth, have them experience an anti-humanist epiphany, and connect to Christianity en masse.” He then provides some conversion resources.
• The Fall 2016 edition advises every man to become a “LONE WOLF GENDER WARRIOR” by using jury nullification to “nullify laws which unfairly discriminate against men. Some of those laws include statutory rape, and domestic assault cases where “the women the deserved to be raped or smacked.”

Near the conclusion of the article, Dimitri the Lover writes:

REMEMBER: Laws are supposed to prevent bad people from doing bad things, and good people from getting fucked over by bad people or by a system corrupted by bad people. As a man, you have dominion over all creatures, so it is your MORAL DUTY to protect the meek and innocent, and to mete out justice to the evil and guilty.

Application of s. 319(3)(c) Defence

[33] Mr. St. Germaine, in written submissions, submits that there is evidence that the statutory defence outlined in s. 319(3)(c) is available to him. Again, it was conceded that as publisher, Mr. St. Germaine is aware of the content and distribution of YWN. Mr. St. Germaine told police that he has the final say on the content. He maintained that he didn’t think that Sears was crossing any lines and that he trusts his knowledge and ability. St. Germaine read all of the articles and did his own research if he felt that to be warranted.

[34] Mr. St. Germaine argued that his police statement provided the basis upon which I could conclude that he reasonably believed the statements made regarding Jews and women as true since he fact checks before publication. As indicated above, to believe that one should celebrate Hitler and deny the Holocaust of Jews by the Nazis, has no basis in reason. To advocate rape and proclaim women to be less than human, has no basis in reason.

Conclusion

[35] I conclude that both men were fully aware of the unrelenting promotion of hate in YWN and intended that hatred to be delivered to others. Both are found guilty as charged on each count.

1. The misogynistic messages conveyed by YWN are evocative of the types of expression and devices used to expose groups to hatred. These “hallmarks of hatred” include:

Blaming women for perceived societal problems and ills

• Feminism is blamed for “chemically and psychologically castrating Western men” and James Sears offers seduction counselling to teach men how to tame FemiMarxist shrews. (Tab 11, p. 9)
• Feminism uses women “for the purpose of inflaming hatred against the Christian religion, hatred against men, hatred against the beauty of women, hatred against the equilibrium of families.” (Tab 12, p. 16)
• Feminism needs to be dismantled for the good of society: “the greatest threat to the survival of Canada is the decades-long, gradual blurring of gender roles and more recently, gender identity because no society can survive unless their women remain men’s chattel.” (Tab 18, p. 10)
• Feminist organizations are backed by shadowy forces intent on destroying Western Christian culture. Members of the rock band, “Pussy Riot” are described as “ZioWhores” who were “ordered” by their “Jewish handlers” to desecrate a Christian church in Moscow. Similarly, “FemiMarxist activist groups” are “backed by 85 year old ZioMarxist Jewish billionaire George Soros.” A former member of Femen is described as previously being “one of Soros’ bitches”. (Tab 12, pp. 14-15)

De-humanizing women as being inferior to men and deserving of unequal treatment

• There is a natural order of “male authority and female submission.” (Tab 18, p. 10)
• The election of Donald Trump heralds “the year of the Cock, … representing the reestablishment of God’s benevolent Patriarchy during which strong, powerful polygamous men will destroy Feminist ideology and protect all of God’s flock from Satan”. (Tab 16, p. 7)
• Article titled “Menstruation Nation Bows to the Patriarchy!” celebrates the victory of a “Pussy-Grabbing Straight White Christian Male” over “Satanic FemiMarxist hag Hilary Clinton”. This “decisive victory” for the Patriarchy “was about to viciously swing the cultural pendulum back toward God’s Natural Order.” Every man reading this article is commanded to make “a solemn pledge to be a LONE WOLF GENDER WARRIER in the war to rid society of ‘Cultural Marxist filth’.” (Tab 16, pp. 10-11)

Women of colour are further demeaned:

• Women of colour are worthy of seduction if they are attractive by “European standards”. The author rates “Negressess” on the scale of “Michelle Obama (coarse facial features, linebacker body) to Halle Berry (fine facial features, porn star body).” (Tab 19, p. 9)
• A black woman labelled a “Negress” is depicted on her knees with a chain around her neck on a metal leash that is held by a white man. (Tab 4, p. 6)
• Photo collage depicting Megan Markle on hands and knees, wearing bra and thong, with a line of clowns behind her, waiting to have sex with her. Her husband, Prince Harry, standing to one side, says, “Sorry Madam but since returning from a British Army campaign in the jungles of Sierra Leone, I’ve had the ‘fever’. I’d take an even swarthier clap trap if you had one.” Beside him, a man in military garb who is directing the clowns states (to a woman standing beside Markle), “Madam, Harold fancies the demi-negress but I fear that once the clown troupe exhausts its seed, she’ll be so worn the constabulary will be forced to put her down.” (Tab 22, p. 10)

De-humanizing women by comparing them to dogs, property, and reducing their worth to their genitals and reproductive capabilities

• In an article providing advice to men on how to manipulate women into having sex with them the day after Valentine’s Day, the author likens a man’s relationship to a woman to dog ownership, based on “that innate drive to care for and protect one’s possession.” For a man to “be spontaneously romantic”, he “must feel that his woman is higher echelon chattel meant to be protected from theft or damage and worshipped like a fine automobile.” In the same article, women’s genitals are described as “Valentine Vulva” or “heart-shaped box of Beaver” and certain women are noted to place “low value on her orifices” such that they are easy targets for male manipulation. (Tab 12, pp. 10-11)
• Women are “tri-orificed chattel”. (Tab 17, p. 12)
• “In most western countries today, even ravaging one’s own chattel (‘raping’ one’s wife) has been criminalized!” (Tab 15, p. 10)
• Some women are not “rape worthy” by virtue of their physical unattractiveness. (Tab 18, p. 10; Tab 22, p. 5, image caption)
• A woman’s worth is reduced to having a “grope-worthy pair of breasts!” (Tab 12, p. 14)
• Women are warned that their sexual market value is “about to plummet because at this very moment patriarchal male scientists who view you as merely life supporting unit for a uterus and vagina, are employing their vast male brainpower to make you obsolete [through artificial uterus technology]”. “Sex robots” can replace women as child caregivers – “nanny of the future” and as sex objects: reference is made to a Spanish doctor who is creating “a robot that’s as good a fuck as a ‘real’ woman. The author allows that there are “some good women” but most (or at least millennials…) are not fit to raise a child. He writes, “As skeptical as I am about the benefits of AI, I would rather my kid be raised by the monster I can program than the one who operates on instinct.” (Tab 22, pp. 12-13)

Depicting women as liars, manipulators and as being incapable of rational thought

• Seduction can be accomplished by manipulating, patronizing and looking down upon women and by using a “Rasputin MindRape Seduction Method” (Tab 12, pp. 10-11)
• Women are contrasted with men, in terms of their ability to lie and deceive: “Even though it is against your male instinct to lie (women lack men’s moral fibre, so they can lie without remorse) …” (Tab 15, p. 10)
• Women should not have the right to vote because “women do not have the mental faculties or temperament required to make consistently rational voting decisions”. Trump nearly lost the recent election due to “women’s fragile brains being mind-fucked by the ZioMarxist-controlled mainstream media’s spin on ‘pussy grabbing’ and his other normal heterosexual male behaviours.” (Tab 17, p. 12)
• “Most women are irrational, short-sighted, passive-aggressive traitors who cannot be trusted with a vote. That is why we keep electing charming assholes who sell us out to foreign interests, corrupt the morals of our society and open the gates of our nation to ungrateful foreigners who seek to rape, pillage and plunder our country.” (Tab 17, p. 13)
• In describing why women ought to be men’s chattel, Dimitri the Lover writes: “women have the emotional maturity of children … but with advanced cunning which allows them to destroy a family by manipulating its members into putting her interests ahead of those in the home. Cunning and lying are evolutionary adaptations…” (Tab 18, pp. 11)

Celebrating and trivializing violence against women

• YWN also advocates for a change in terminology because “rape is such a trigger word nowadays”; instead, Sears believes there should be a new and better way to describe forced sex, calling it “vaginal break and entry” or “VIBE” for short. “Vibe Culture’ creates the mental image of irresponsible people on both sides of the forced sex act, which is pretty much grounded in reality.” (Tab 4, p. 13; Tab 22, p. 5).
• Forced penetration is equated with a property crime. James Sears describes a man who “weasels his way in” by sticking his foot in the door as “bad door etiquette”, while a man who breaks in and creates damage as a “home invasion”. (Tab 22, p. 5)

Advocating physical violence including sexual violence against women

Male rage against women is justified and physical violence should be used as a tool to keep women in line:

• Response of James Sears to letter to the editor – “I am trying to set a positive example, but it is so frustrating promoting masculinity in such a feminized culture. Men have become pussy-whipped fags. A generation ago rarely a day passed by when you did not witness a man pinning his woman up against a wall by her shoulders or meting out a strategic slap whilst chastising her for something she did. Forced penetration is not sexual assault if it does not entail gratuitous violence:

Using highly inflammatory and derogatory language to describe women who are seen as disobeying the so-called natural sex-hierarchy

Citing references from sources to support and legitimize negative generalizations about women

• In an article about why woman should not have the right to vote, James Sears states, “Every notable intellectual has recognized that inherent cognitive defects in women prevent them from making rational decisions”. Sears goes on to quote from a 19th century “esteemed German ‘Metaphysical Philosopher’” Arthur Schopenhauer: “…women remain children all their lives for they always see only what is near at hand”; “It is because women’s reasoning powers are weaker that women are inferior to men in matters of justice, honesty and conscientiousness … they have ‘no sense of justice’ … they are instinctively crafty and have an ineradicable tendency to lie.” (Tab 17, p. 13)

a. Hatred against Jews

2. Professor Penslar explained that YWN espouses anti-Semitic doctrines in both its textual and visual representations. In its simplest sense, anti-Semitism is an expression of hatred toward Jews. Professor Penslar organized the mechanisms of anti-Semitism employed by YWN into six categories:

3. Expressions of revulsion against the Jewish faith and its practitioners: The depictions of Jews are informed by long traditions of religious anti-Semitism. The Jewish faith is consistently associated with witchcraft and deception. The Talmud is vilified as satanic and described as preaching hatred against non-Jews. Jews are also described as engaging in blood rituals, including consuming the blood of Christian children.

4. Accusations that Jews were collectively responsible for Bolshevik atrocities in the USSR: Jews and Jewish sympathizers are described as “ZioMarxists” and are accused of being involved in revolutionary leftist causes in general and with the leadership in the former Soviet Union in particular. YWN perpetuates the Judeo-Bolshevik myth that Jews are responsible for Bolshevik terror by exaggerating and distorting Jewish involvement in the Soviet Security Services. For example, YWN wrongly attributes the deaths of every individual who died in the USSR between 1917 and 1953 to the Jews. Hitler famously and routinely linked Bolshevism with the Jews during WWII.

5. Claims of Jewish conspiracies to conquer and control humanity, especially through banking and finance: YWN frequently refers to Jewish financial dominance historically and in modern day. Jews are oft described as being part of global banking conspiracies, including when Prime Minister Pierre Trudeau signed away the Bank of Canada to the Rothschilds, leading to an increase in private and public debt. The myth of Jewish financial conspiracy is frequently portrayed in images where figures like Rothschild or George Soros are depicted as a puppeteers, manipulating the leaders of Canada on strings. In these depictions, the puppeteer takes a demonic form. Jews are also blamed for secularization, multiculturalism and the rise of feminism in Canada.

6. Demonization of the state of Israel: Israel is depicted as the point of origin and main beneficiary of Jewish global conspiracies. YWN’s depiction/critique of Israel is anti-Semitic. Israel is said to be behind the 9/11 terrorist attacks and the creation of the terrorist group ISIS. Israel’s conflict with Palestine is presented as resulting from “Israel’s Talmudic bloodlust”. The Israeli conspiracy is depicted as far-reaching, as many Evangelical Christians have been duped.

7. Holocaust denial: YWN denies that Jews were the victims of a genocide and paints the gas chambers created to kill Jews as “myths”. The Holocaust is referred to as the “Holohoax” and described as the “biggest lie of the 20th century”. The myth of the Holocaust is attributed to Jewish forces to promote their collective political and economic interests.

8. Glorification of Nazism and Adolf Hitler: YWN’s reverence for Nazism undergirds and informs all of the other mechanisms through which anti-Semitism is expressed in YWN. YWN and James Sears’ political party the New Constitution Party of Canada emulate Nazi discourse and symbols. Hitler is revered as an environmentalist, a protector of strong family values, and the father of Canada’s universal healthcare system.

9. The anti-semitic statements and depictions communicated in YWN promote hatred against Jews. The messages conveyed by this material are evocative of the types of expression and devices used to expose groups to hatred. These “hallmarks of hatred” include:

Jews are simultaneously elevated and denigrated as a supremely powerful force of evil.

YWN simultaneously elevates Jews to a supremely powerful force, controlling many global systems and perpetuating atrocities worldwide, while at the same time denigrating Jews as evil and inferior. These references appear throughout the publication. The implication is that it is the Jews, not the Nazis, who are the real forces of evil in the world.

Jews are portrayed as a powerful menace that have taken control of global finances, the media, and political systems

• Jews control the banking system in Canada and are responsible for Canada’s debt: “Then in 1974 traitor Pierre Trudeau did the unthinkable … he gave away control of the Bank of Canada to Jacob Rothschild and his cronies. Up until then the Bank of Canada printed INTEREST-FREE money for its own use, or to loan to provinces and municipalities for infrastructure projects. But Rothschild would have none of it! • ZioMarxist overlords oversee Minister of Environment and Climate Change Catherine McKenna (Tab 11, p. 16)

Jews are visually depicted as clandestinely controlling non-Jews:

The moment even the smallest skirmish erupts anywhere in the world, a Zionist ‘negotiation team’ with wads of cash will rapidly deploy to quell it… the TOTAL OPPOSITE of what they do now!” (Tab 10, p. 11)

Jews that do not convert to Christianity are worthy targets of violence and extermination:

• “The light told me to forgive common Jews for celebrating, benefiting from, and partaking in, two millennia of evil that the Pharisees had inflicted upon the Earth. I was told to shower the Jews with ‘tough love’ in the form of enlightening them as to their sins. I was then entrusted with bringing them to Jesus Christ… I learned time was of the essence to perfect the Jews, because during one of the three years that I had envisioned, ‘The Great Pogrom’ would commence (I was not made privy as to which year). Only 144,000 Jews (about 1%) would survive because they followed their Torah TO THE LETTER and rejected the Satanic Babylonian Talmud. The only hope for the other 99% of Jews was to come to Jesus Christ.” (Tab 16, p. 6)
• [James Sears’] main goal of pointing out Jews’ crimes is to “shatter their supremacist myth, have them experience an anti-humanist epiphany, and convert them to Christianity en masse. My mission has become more time-sensitive due to the rapid rise of the ‘Alt-Right’, whose main goal is to zealously rid North America of ZioMarxist influence, placing Jews in danger. Jesus came to save Jews from themselves, and my Prophesy is to save Jews from Gentiles. Unfortunately, Jews possess a genetic neuroticism and paranoia, causing them to mistrust good intentions of others.” (Tab 19, p. 16)
• “Jews are obsessed with myths about gas chambers and ovens. But there is one REAL oven that the Zionist Talmudic Jews who murdered this boy should be worried about: GOD’S OVEN. It is called HELL and it is where they are going to go if they do not immediately repent for their sins and accept Jesus Christ into their hearts.” (Tab 7, p. 5)
• James Sears describes a poorly-behaved German shepherd named Shadow - “Hilariously, any time a guest mentioned ‘Jews’, ‘Israel’ or ‘Zionism’, Shadow mauled them (a true GERMAN shepherd).” (Tab 4, p. 9)

Jews are described using highly inflammatory and derogatory language

• YWN frequently uses the term “ZioMarxist”. “Zio” is a derogatory term for Jews.[^1]
• Jews are “ZioSatanic”. (Tab 10, p. 6; Tab 11, p. 14)
• Jews are “bloodthirsty”. (Tab 8, p. 5; Tab 16, p. 17)
• Jews are “parasites”:
  • George Soros is described as a “parasite” (Tab 12, p. 14)
  • “Pierre Trudeau surrendered Canada to the Globalists in 1968 and our Bank of Canada to the Rothschilds in 1974. Since then our debt has ballooned as we have been paying interest to banking parasites and our military has done the bidding of Globalist parasites, most recently by Justin Trudeau supporting Zionist-backed Muslim terrorists in Syria.” (Tab 22, p. 2)
  • YWN uses the catchphrase “expel the parasite” throughout.
• Jew is used as an adjective: “I reminded Jan of all the money he ‘Jewed’ me out of in addition to the initial $15,000…” (Tab 4, p. 10)
• Jews are “terrorists”. (Tab 8, p. 5)

Jews are de-humanized as demonic or reptilian creatures

• Jews are represented as serpents (Tab 6, cover), monsters (Tab 15, p. 15), horned beasts with cloven feet. (Tab 19, cover; Tab 16, cover)
• A Jewish postal worker is described as a “Postie Putz” (Putz is Yiddish for “prick”), and depicted as a caricature, with a contorted face, red eyes, and the forelocks of a Hasidic Jew. (Tab 3, p. 1)

YWN trivializes and celebrates past persecution of Jews

YWN denies the severity and existence of the Holocaust and accuses Jews and the State of Israel of inventing and/or exaggerating the Holocaust:

• “The biggest lie of the 20th century is that ‘6 million Jews were gassed’ (there were no gas chambers, only a few thousand Jews tragically died due to starvation and a typhus epidemic that rapidly spread through the concentration camps at the tail end of the war, and there is ZERO DOCUMENTED EVIDENCE of a planned extermination of Jews by Adolf Hitler).” (Tab 13, p. 10)
• Response of James Sears to letter to the editor – “I STRONGLY resent your orphaned use of the term ‘Holocaust’ with absolutely no adjective to provide ethnic context, as if the word is exclusively reserved for use by Jews. This sort of arrogant sense of entitlement displays an inherent supremacist attitude that is common amongst your people.” (Tab 3, p. 14)
• “Unlike Hitler, Morgentaler participated in a REAL Holocaust of 6 million people… Morgentaler, a Christian-loathing Talmudic Jew and ‘concentration camp survivor’, refused to abort a Jewish baby, claiming his religion forbid it because it might be ‘The Messiah’ (it was really because ‘The Talmud’ says Jews are sacred beings whereas non-Jews are subhuman and can be killed). ZioMarxists spread many lies about Adolf Hitler. The most common is that 6 million Jews were “gasses”. Another is that Hitler promoted abortion of “inferior races”. In reality, there were no gas chambers and Hitler banned abortion because he considered it murder.” (Tab 11, p. 7)
• Image of a dog wearing a Kippah. The caption provides “The only dog more nervous about the ‘refugees’ than me is my neighbour, Shekel. But his grief gives me great schadenfreude because he’s annoying, constantly yelping that I should pay for his kibble because he claims my breed put down 6 million Corgis in some mythical ‘Corgicaust’.” (Tab 11, p. 12; another reference to the “mythical Corgicaust” is made at Tab 16, p. 14)
• Shep (a German Shephard) is depicted reading a book titled “Auschwitz – Holocaust in pictures” and thinking “Man, these Yids love fiction novels.” (Tab 17, p. 14)
• “In 1991 Grant Bristow posed beside a sign outside the Dachau ‘concentration camp’ in Germany to illustrate the FALSE ‘Jewish Holocaust’ narrative of 6 million Jews being gassed to death. The sign reads ‘Arbeit macht frei’, German for ‘work sets you free’. Dachau, Auschwitz and every other German ‘concentration camp’ had the same slogan on their gate because they were all work camps, NOT death camps!” (Tab 18, p. 15)

Jews are behind the myth of the Holocaust:

• The Holocaust is referred to as the “Holohoax” and as a “Holohoax myth”. (Tab 13, p. 10; Tab 14, p. 3; Tab 22, p. 19)
• The Holocaust is a “big lie” perpetuated by the ZioMarxist-controlled mainstream media (Tab 10, p. 16) and Jews are behind it (Hitler “coined the term ‘BIG LIE’ to refer to an outrageous propaganda technique used by Jews; a lie so colossal that no one would believe someone could have the imprudence to distort the truth so infamously” - Tab 17, 4)
• “Many Jewish readers of our paper have told us they know the ‘Jewish Holocaust’ was a blood libel hoax perpetuated against the German people. Some, like your family, are brainwashed. The only way for them to be deprogrammed is for awakened Jews like you to bombard them with the truth.” (Tab 14, p. 19)

YWN celebrates Nazism in general and German dictator Adolf Hitler in particular:

• Advertisement for the NCP party contains membership cards that are nearly identical to a 1934 Hitler Youth recruitment poster.[^2] (first seen at Tab 2, p. 2)
• Advertisement for the 1st Annual Toronto Old-Fashioned Anti-Marxist Book Burning. The ad contains images of the 1937 Nuremberg rally and Nazi book burnings. (First seen at Tab 5, p. 2)
• James Sears is depicted in armor on a horse with the New Constitution Party flag. Sears has grafted his face onto a famous painting of Hitler.[^3] (Tab 2, p. 15)
• “Because ‘Nazis’ promote strong family values, paedophiles join Marxist organizations like Antifa or the Liberal Party, as these groups purport to be ‘Anti-Nazi’. Traditional Canadians must stop viewing ‘Nazis’ as evil and start adopting some of their doctrines, including strong special policies and laws governing: child welfare, public health, community cohesion, healthy sexuality and gender roles, eradication of degeneracy, animal rights, food safety and the environment.” (Tab 18, p. 12)
• The ZioMarxist-controlled media deliberately depicts Hitler as evil:
  • “Do NOT believe the LIES that the ZioMarxist-controlled mainstream media is feeding you about Adolf Hitler. For a true picture of The Fuhrer, please watch the online documentary ‘Adolf Hitler: the Greatest Story NEVER Told’... We especially encourage our Jewish friends to watch the film so that they can be de-programmed from the anti-German propaganda they have been fed for decades.” (Tab 2, p. 13; see also Tab 6, p. 13)
  • “Don’t believe the lies you have been fed by the ZioMarxist-controlled mainstream media! Hitler loved all races. National socialism welcomes all races. We especially encourage young Jews to keep an open mind and embrace Adolf Hitler.” (Tab 6, p. 12)
• “DailyStormer.com (world’s #1 alt-right site) interviewed me. To celebrate, I founded a ‘Hitler Fan Club’ with 4 men who saw me on TV.” (Tab 14, p. 3)
• Canadians should thank Hitler for universal health care. (Tab 20, p. 5)
• A baby dressed up as Hitler is described as “cute”. (Tab 8, p. 11)

YWN manipulates the truth and cites seemingly scholarly sources that have been widely discredited, or historical documentation out of context, to support anti-Semitic assertions

• YWN perpetuates the “Bolshevik myth” by exaggerating Jewish involvement in Soviet security services (Professor Penslar testified that Jews in security services until they were purged and killed in 1930s for various reasons) and by blaming Jews for every death in the Soviet Union from 1917 to 1953:[^4]
  • Jews are depicted as being solely responsible for massacring 50 million Orthodox Christians in the Soviet Union. “Genrikh Yagoda, a ZioMarxist Jew who loathed Christians (most of Stalin’s high ranking henchmen were Jews) personally oversaw the murder of 10 million Orthodox Christians”. (Tab 1, p. 15)
  • “A fifth column is a group of people who undermine a larger group…. historically Jews have been some of the most notorious fifth columnists…. Bolshevik Jews murdered Tsar Nicholas II & the Romanov family, murdered 50 million Orthodox Christians, outlawed Christianity, and burned down almost every church (every synagogue and Rabbi was spared). 20 years later, due to well-placed paranoia, Stalin purged most Jews from high government positions before they could assassinate him.” (Tab 11, p. 10)
  • “Many Jews sold their soul to the devil of Marxism and have blood on their hands for eternity. In 1934, 38.5% of the most senior posts in the Soviet security apparatuses were held by Jews.” (Tab 16, p. 16)
• YWN uses the existence of the Rothschild bank and the fact that the Canadian economy fell into a deficit in the 1970s to create the myth of Jewish financial control and responsibility for financial irregularity.[^5]
• Jews were involved in the slave trade, but they played a minimal role. YWN takes the fact that some Jews were involved to express the belief that Jews as a group are responsible for the slave trade. (Tab 15, p. 16)
• The claim that “Hitler and his Zionist Jewish collaborators teamed up to move Jews into concentration camps” is not true. (Tab 5, p. 3)[^6]
• The Khzar are represented as group of people who converted to Judaism (historically, the number of converts is unknown) and are referred to as a Phallus worshipping satanic cult in order to suggest that present-day Jews are satanic. (Tab 18, p. 16)
• While Israel is a real state engaged in real conflict, the accusations that Israel is behind 9/11 and other atrocities worldwide are baseless.[^7]
• Fred Leuchter is praised as an “expert forensic analyst” and his 1988 report denying the existence of gas chambers in Auschwitz is called a “devastating document” even though Leuchter and his report have been widely discredited.[^8]
• YWN uses an out-of-context quote from Winston Churchill to support its anti-semitic assertions. (Tab 1, p. 12)
