On appeal from the decision of Justice B. J. Wein of the Superior Court of Justice, sitting as a summary conviction appeal judge, dated October 15, 2009, denying the appellant’s appeal from conviction by Justice R. W. Rogerson of the Ontario Court of Justice, dated February 12, 2009.
APPEAL BOOK ENDORSEMENT
[1] Leave to appeal is denied. The appellant accepts that the proposed appeal does not raise a question of law that has significance to the administration of justice beyond the four corners of this case. As for the second test, the appellant has failed to satisfy us that the trial judge committed any error, let alone a “clear” error of law in his analysis or conclusion.
[2] Accordingly, leave to appeal is denied.
