DATE: 20091208
DOCKET: C50415
COURT OF APPEAL FOR ONTARIO
Doherty, Moldaver and Epstein JJ.A.
BETWEEN:
Her Majesty the Queen
Respondent
And
Seth Purkis
Applicant (Appellant)
Counsel: Daniel F. Moore, for the appellant Margaret S. Loda, for the respondent
Heard and endorsed: December 4, 2009
On appeal from sentence imposed by Justice John D. D. Evans of the Ontario Court of Justice dated April 7, 2009.
APPEAL BOOK ENDORSEMENT
[1] The Crown fairly concedes that the length of the conditional sentence (2 years less one day) was manifestly excessive in the circumstances and asks that we reduce it to twelve months. We accept that submission and would reduce the sentence accordingly. That will mean that when the appellant is released in respect of the offences in the companion appeal (C51056), he will have four months left on his conditional sentence. In all other respects, we would not interfere with the sentence imposed by the trial judge.
