APPEAL BOOK ENDORSEMENT
[1] We agree with the careful reasons and conclusions of the motion judge.
[2] We are also satisfied that s. 46.1 of the Human Rights Code creates a new substantive jurisdiction and that it should be read prospectively only. The section came into force in June 2008 and cannot reach the events in issue in this action.
[3] The appeal is dismissed. Costs to the respondents in the amount of $1,500, inclusive of disbursements and GST.
