APPEAL BOOK ENDORSEMENT
[1] The appellant attempted to raise the family property issue before Justice Lemon. There appears to have been a misunderstanding and the issue has not been finally disposed of.
[2] We would dismiss the appeal, but on the basis that the appellant is free to seek to set aside the stay granted by Justice Thomas on January 9, 2003. The other issues raised in the application before Justice Lemon have been finally disposed of.
[3] The appeal is dismissed with no order as to costs.
