Heard: December 3, 2008
On appeal from the judgments of Justice Paul M. Perell of the Superior Court of Justice dated December 12, 2007, and costs orders dated January 31, 2008.
ADDENDUM
Gillese J.A.:
[1] After the reasons in this matter were released, counsel for the appellants drew the court’s attention to para. 65 of those reasons, which recites that Dionisio and Dias were separately represented from Ferreira on the applications. In fact, they were not. However, separate applications had been brought, one by Ferreira and the other by Dionisio and Dias. Thus, the costs disposition remains appropriate.
[2] Accordingly, I would decline to reconsider the matter of costs of the applications.
