APPEAL BOOK ENDORSEMENT

[1] The sentence imposed was grossly excessive. It was double what Crown counsel was seeking at trial and was out of all proportion to what occurred.

[2] Accordingly, the appeal is allowed and the sentence reduced to time served (4 months in addition to 238 days credit for pre-sentence custody).
