COURT OF APPEAL FOR ONTARIO
CITATION: R. v. Papadopoulos, 2009 ONCA 187
DATE: 20090302
DOCKET: C49389
O’Connor A.C.J.O., Rosenberg and Goudge JJ.A.
BETWEEN:
Her Majesty the Queen
Respondent
and
Stefano Papadopoulos
Appellant
Victoria Rivers, for the appellant
Jennifer Woollcombe, for the respondent
Heard and released orally: February 25, 2009
On appeal from sentence imposed by Justice Alan Cooper of the Ontario Court of Justice dated May 7, 2008.
ENDORSEMENT
[1] We think it unlikely that the trial judge could have misapprehended the nature of the prior conviction given the extensive submissions made by defence counsel and that the reasons for sentence from that earlier proceedings were before him. In any event, given the serious nature of these offences and that the appellant was on probation at the time and subject to firearm prohibition, we are of the view that the sentence was fit. We agree with the trial judge that deterrence and denunciation were the paramount objectives. The trial judge did not give inadequate weight to rehabilitation.
[2] Accordingly, while leave to appeal sentence is granted, the appeal is dismissed.

“S.T. Goudge J.A.”
