APPEAL BOOK ENDORSEMENT
[1] It is conceded by the respondent that the motion judge erred in holding that the matters raised by the motion are within the exclusive jurisdiction of the Ontario Rental Tribunal. We agree. However, the matters raised by the appellant were not susceptible of disposition by way of motion. The subject matters of the claims are within the jurisdiction of the Superior Court.
[2] Accordingly, the appeal is dismissed and the order below is varied by deleting the second sentence of the last paragraph. There will be no order as to costs.
