[1] We have reluctantly concluded that in the circumstances, this appeal must be adjourned yet again given the nature of the allegations in the fresh evidence motion and the recent change of solicitors by the respondent. Appeal is to be heard January 17, 2005. That date is peremptory on the respondents.
[2] Any responding material on the fresh evidence motion to be filed by November 30, 2004 including any material from Mr. Leighl in respect of his own interest.
[3] Cross examination to be completed by December 15, 2004.
[4] Amended factum if so advised from appellants by December 30, 2004.
[5] Respondents’ factum by January 7, 2005.
[6] Costs of today reserved and that matter adjourned to Friday, November 19 at 10 a.m. to afford Mr. Leighl an opportunity to respond to the submission that he pay the costs of today personally.
