[1] By the Court: In our view, Swinton, J., made, as applicable to a motion for summary judgment, no error in the principles she articulated or in their application to the disposition of the motion for summary judgment before her. The appellants produced no evidence on the motion of publication by the respondents beyond the publication to Mr. Lang, which was absolutely privileged.

[2] The appeal is therefore dismissed with costs, fixed in the amount of $5,000, inclusive of disbursements and GST.

Appeal dismissed.
