[1] By the Court: We agree with the reasons of Hockin, J. For the purposes of Rule 60.08(1.1) the bank account here was a debt payable to the partnership, the holder of the account not to Mr. McClintock, among others, as a partner.

[2] The appeal is dismissed with costs.
