Court of Appeal for Ontario
Antonacci v. Great Altantic & Pacific Company of Canada Limited
Date: 2000-02-10
Docket: CA C29388
Howard Levitt, for Appellant.
Maurice W. Pilon, for Respondent.
Per curiam:
[1] Subsequent to the release of the court’s reasons, counsel for A & P wrote to the court requesting an opportunity to make further submissions on the issue of costs awarded at trial. Counsel also pointed out that subsequent to the release of her reasons, the trial judge had adjusted the general damages awarded to reflect certain additional workers’ compensation benefits paid to the respondent. Consequently, the respondent received general damages in the amount of $15,760.32 and not $26,708.85 as indicated in paragraph 1 of the reasons of Charron J.A.
[2] We have considered the submissions made by counsel for A & P and those made in response by counsel for the respondent. We remain satisfied that the costs order made by the trial judge should stand.
Order accordingly.
