[1] At this case conference, we addressed the following issues:
a. Disputes about the admissibility of certain expert reports; and b. Estimate of trial length;
[2] At the last case conference, issues arose with respect to whether leave was required to file certain defence expert reports. I asked counsel to have meaningful discussions about the issue. I am advised that the issue has expanded to encompass other concerns relating to certain reply expert reports delivered by the plaintiff. However, to their credit, counsel is making progress at resolving the issues, but require more time to do so.
[3] Similarly, counsel have made progress on narrowing the gap in their estimates of trial time required. Resolving the expert report issues will assist in narrowing the gap further.
[4] We will revisit these issues at our next case conference, which shall be held on June 17, 2024 at 10 a.m. for two hours.
[5] At that time, we may also receive a further update from the plaintiff with respect to one of its expert witnesses who has taken ill.
