Addendum
[1] This addendum is issued to clarify the reasons in Rathod v. Chijindu, 2024 ONCA 625.
[2] Paragraphs 10 and 12 of the reasons state that the moving parties requested this court to dismiss the appeal because Roberts J.A.’s costs orders remain outstanding and, in the alternative, to require the responding parties to pay the outstanding costs orders made by Roberts J.A: see Rathod v. Chijindu, 2024 ONCA 317. I note that the moving parties also requested this relief due to additional unpaid costs orders made by a three-judge panel of this court in Rathod v. Chijindu, 2024 ONCA 420.
[3] The references to the “outstanding costs orders” in paras. 18 and 20 of the reasons include the costs orders made by both Roberts J.A. and the panel. The panel ordered costs in the following amounts: $4,000 to be paid to Bluekat Capital Corp. and $6,000 to be paid to Ms. Rathod. Thus, in total, the responding parties shall pay $19,000 to Bluekat Capital Corp. and $12,780 to Ms. Rathod by August 28, 2024.
