Reasons for Decision

[1] In the circumstances, we are prepared to put this matter over to a new appeal date. All materials necessary for the hearing of this appeal, including the reply factum of the appellant, will be filed no later than February 1, 2023. The reply factum will be no longer than five pages in length. The appeal will be heard on February 13, 2023.

[2] Costs are to be paid by the appellant to the respondent in the amount of $2,500, all-inclusive, representing costs thrown away relating to today’s attendance.
