ENDORSEMENT
[1] We released reasons on July 29, 2026 granting this application for judicial review: Aubin v. Law Society, 2026 ONSC 4377 (Div. Ct.). Para. 35 of the reasons states: “Neither party seeks costs and none are granted.” It has been brought to our attention that this was in error and that while the respondent did not seek costs, the applicant did and provided a costs outline. It is appropriate that we amend our reasons to correct this error.
[2] When we raised costs with the parties at the hearing, the LSO advised that it wished to make submissions on costs after the decision was released. As we indicated at the time, in this court parties are required to file their complete costs materials prior to the hearing. Where those materials include an offer to settle, that may be sealed. This court does not hold its hearings in two tranches – one on the merits and then separately on costs.
[3] Costs are fixed at $17,000.00, inclusive of taxes and disbursements, payable by the respondent to the applicant within 30 days.
