McCabe A.J. dated February 5, 2026 (2026 ONSC 715), is quashed, with costs of $1,000, inclusive, payable by the Moving Party to the Responding Party within thirty days. Appeal from the impugned order is as of right to a Superior Court Judge: Courts of Justice Act, RSO 1990, c. J.1, s. 17, and not to this court. We order reduced costs in this court because recourse was not had to r. 2.1 to dispose of this motion summarily, to save time and expense for the parties and the administration of justice.
