1This matter came before me at a case conference in my capacity as a Local Administrative Justice for the Divisional Court, to address procedural matters only.
2The Appellant sought an appeal to the Ontario Court of Appeal, but it was re-directed to be heard by a panel of the Divisional Court. It appears that the Appellant is moving to appeal the decisions Justice Nicholson dated April 2, 2026, and my endorsement dated April 24, 2026 dismissing a motion to stay the order.
3The Appellant may request that a panel of the Divisional Court review the decision of a single judge of the Divisional Court pursuant to s. 21(5) of the Courts of Justice Act. Therefore, if the appellant seeks a review of either order, it shall go before a panel of the Divisional Court, which sits twice a year in the Southwest Region, usually in April and November.
4Justice Thorburn of the Court of Appeal granted a stay pending the return of this matter to the Divisional Court. There is no automatic stay when applying for a panel to review a single judge’s order. If the appellant wishes to continue to seek a stay pending the panel’s review of the orders, she must bring a motion in our civil motions court and ask for the court to grant a stay of the orders under review (i.e., lifting the stay of eviction) pending the panel’s review: Rule 63.02(1) of the Rules of Civil Procedure; and in accordance with motion procedure under r.37 of the Rules.
5In the circumstances, I will give the appellant an opportunity to seek a stay and hereby grant an interim-interim stay, pursuant to s. 134 of the Courts of Justice Act, on condition that the appellant’s motion for a continued stay is brought returnable on a regular Friday motion court in London no later than June 12, 2026, and subject to such other terms that may be imposed by the judge hearing the motion. If no motion is heard by that date, the stay is lifted with immediate effect, unless there is a further order.
6The Appellant sought accommodations from the court due to her disabilities, which I am told relates to Autism. In particular, she seeks to have her boyfriend Shaun Corlett act as her agent. He is not a lawyer nor licenced paralegal. There was no evidence before me at this case conference, so I am unable to determine the nature or extent of Ms. Little’s “disabilities”. I urged Ms. Little to seek legal advice and consider appointing a Litigation Guardian if she felt incapable of understanding or managing the appeal: Rule 7 of the Rules of Civil Procedure.
7Today only, for the purposes of dealing with the procedural matters, including setting the timetable, I permitted Mr. Corlett to speak for Ms. Little (also present).
8Given the Appellant has stated that she intends to seek a panel review of the orders, the parties have agreed to the following timetable:
The Appellant will serve and file her motion materials to a Judge at a regular motions court no later than June 12, 2026, as per the Rules.
The Appellant will serve and file her materials for the Divisional Court Panel Review within ninety (90) days of this endorsement.
The Respondent will serve and file Responding materials for the Review within thirty (30) days of receiving the Appellant’s materials.
The Appellant will serve and file any Reply materials within thirty (30) days of receiving the Respondent’s materials.
The parties are permitted to serve court documents through email communications at:
a. The Respondent jnaccs@gmail.com, and aleshailenelittle07@gmail.com; and
b. Both parties must only communicate about the litigation in a respectful and polite manner through email.
9If there is non-compliance with the timetable imposed in this endorsement, the stay is lifted with immediate effect, unless there is a further order.
