ENDORSEMENT

[1] This endorsement reflects a settlement reached in this case during the course of hearing the Mr. Daraei’s motion for a stay.
[2] On the consent of the parties, this court orders as follows:
a. The stay motion and the underlying intended application are stayed pending completion of the terms set out in this decision or other order of this court;
b. Monthly rent is $850, payable on the 15th day of each month. Mr Daraei shall pay the monthly rent as it falls due, on June 15th pursuant to the case management order of Matheson J., and on the 15th day of each month thereafter;
c. Mr. Daraei shall pay $300.00 by the last day of June, July and August, towards rent arrears;
d. Mr. Daraei shall pay $600 by the last day of each month, commencing September 30, 2026, until rent arrears have been retired;
e. “Arrears” for the purpose of this order are $4,250;
f. The eviction order of the LTB is stayed pending further order of this court;
g. If Mr. Daraei fails to make any payment required by this order, Mr. Alcivar may ask the court, by email, to lift the stay of enforcement of the LTB eviction order forthwith;
h. If Mr. Daraei makes the payments required by this order and the arrears are paid in full, Mr. Darei may ask the court to quash the LTB order, on consent, on the basis that the tenancy is continuing.
i. D.L. Corbett J. is seized of this matter.
[3] The court thanks both Mr. Daraei and Mr. Alcivar for the constructive approach to these matters.
