ENDORSEMENT

[1] In my reasons for decision dated March 2, 2016 I invited the parties to deliver any costs submissions in writing. I have since received and reviewed submissions from the Respondents. The Appellant has not provided any costs submissions.

[2] The Respondents seek costs on a substantial indemnity basis of $5,637.29 or, alternatively, on a partial indemnity basis of $3,895.39.

[3] As the successful parties, the Respondents are entitled to an award of costs. Considering the straightforward issues on appeal, the nature and extent of the materials prepared and filed as well as the overriding principle of proportionality and the other factors related to costs, I am of the view that a fair and reasonable amount to award to the Respondents for their costs is $3500.00 inclusive of all disbursements and applicable taxes. Accordingly, the Appellant shall pay that amount to the Respondents within 30 days of the date of this Endorsement.
