1In my decision of March 3, 2016, I invited counsel for the parties to deliver submissions on costs in writing, if any such submissions were to be made.

2I now have received and considered submissions from the Respondent. No submissions have been delivered by the Appellant.

3The Respondent was successful on the appeal and seeks costs in the amount of $6,343.82.

4The issues on appeal were comparatively straightforward. When that factor is considered, along with the other factors affecting an award of costs and the overriding principle of proportionality, I am of the view that a fair and reasonable amount to award to the Respondent amount for costs is $3000.00.

5Accordingly, the Appellant shall pay that amount to the Respondent within 30 days of the date of this endorsement.
