[1] In my decision of March 3, 2016, I invited counsel for the parties to deliver submissions on costs in writing, if any such submissions were to be made.

[2] I now have received and considered submissions from the Respondent. No submissions have been delivered by the Appellant.

[3] The Respondent was successful on the appeal and seeks costs in the amount of $6,343.82.

[4] The issues on appeal were comparatively straightforward. When that factor is considered, along with the other factors affecting an award of costs and the overriding principle of proportionality, I am of the view that a fair and reasonable amount to award to the Respondent amount for costs is $3000.00.

[5] Accordingly, the Appellant shall pay that amount to the Respondent within 30 days of the date of this endorsement.
