A.C.J.S.C. MARROCCO (ORALLY)
[1] As between this landlord and this tenant, the essential issue as to whether there is estoppel based on the 2012 final order concerning the description of the premises is, in our view, a hypothetical issue.
[2] Relying on Borowski v. Canada (Attorney General), [1989] 1 S.C.R. 342, we decline to exercise our discretion to permit the appeal to proceed.
[3] The appeal is dismissed as moot.
[4] Under the circumstances as described in the materials by both sides, there will be no order concerning costs.
