[1] In an endorsement released on February 27, 2014 (2104 ONSC 1299), we dismissed Mr. McCarten’s application for judicial review. We invited the parties to make written submissions if they were unable to agree on costs. Subsequently, the court received costs submissions on behalf of the Ministry of Transportation. No other written submissions have been received.
[2] We find the costs sought by the Ministry to be fair and reasonable. Accordingly, an order shall issue requiring Mr. McCarten to pay partial indemnity costs to the Ministry in the amount of $6,275.
