Endorsement re: Costs
[1] The successful applicant seeks partial indemnity costs in an amount exceeding $30,000. That amount is well beyond what a properly advised party in a labour arbitration judicial review would expect to be awarded against it, if unsuccessful.
[2] Even though the matter was of considerable importance to the grievor, it was not overly complex.
[3] We are all of the view that there is no aspect of this matter that takes the costs award out of the accepted range of $5,000 to $10,000 and that a reasonable quantum for an award of fixed costs is $7,500.
