Endorsement re: Costs
1The successful applicant seeks partial indemnity costs in an amount exceeding $30,000. That amount is well beyond what a properly advised party in a labour arbitration judicial review would expect to be awarded against it, if unsuccessful.
2Even though the matter was of considerable importance to the grievor, it was not overly complex.
3We are all of the view that there is no aspect of this matter that takes the costs award out of the accepted range of $5,000 to $10,000 and that a reasonable quantum for an award of fixed costs is $7,500.
