DIVISIONAL COURT FILE NO.: 590/11
SUPERIOR COURT OF JUSTICE - ONTARIO
(DIVISIONAL COURT)
RE: Andrew Rankin v. Ontario Securities Commission
BEFORE: M. Brown, R.S.J., Matlow and Swinton JJ.
COUNSEL: James Lockyer and Richard Posner, for the Appellant Scott K. Fenton, for the Respondent
HEARD AT TORONTO: by written submissions
COSTS ENDORSEMENT
1The Ontario Securities Commission is entitled to costs of the appeal on a partial indemnity basis. This appeal does not raise any issue of broad public interest. Nor does the conduct of staff during the settlement negotiations warrant the denial of costs to the Commission despite its success on the appeal.
2Given this appeal proceeded over the course of two days and required an examination of extensive material, $20,000.00 is a reasonable amount for costs. Therefore, the appellant shall pay costs of $20,000.00 to the Commission, inclusive of HST and disbursements.
M. Brown R.S.J.
