[1] Further to my costs endorsement of September 16, 2013 (2013 ONSC 5838), it turns out that the corporate intervener (the railway) served and filed costs submissions within the time fixed, but their memorandum was not brought to my attention. I have now seen it.

[2] I fix the corporate intervener’s costs at $6,000 and order the applicant to pay them.
