Endorsement

[1] On April 22, 2013, we released our reasons on Mr. More’s appeal of the Order of Perkins J. dated April 13, 2011. The appeal was dismissed with the exception of the calculation of interest. We determined that interest should be simple interest, not compound, and it should begin to run as of March 1, 2001, not February, 2001.

[2] The parties were asked to try to agree on the calculation of interest in accordance with our decision, failing which they were requested to provide us with submissions. The parties were unable to agree and we have received their submissions calculations.

[3] Counsel for Mr. More provided two different calculations: $27,148.50; and $23,200.50. Counsel for Ms. Ross provided a calculation which was higher than that of Perkins J.: $29,110.15.

[4] It is difficult to understand how counsel did their respective calculations. We have therefore done our own.

[5] Our calculations are attached at Appendix A to this Endorsement. They are based the following assumptions:

(i) The calculations are based on the table that was prepared by Ms. Ross and used by Perkins J.

(ii) The calculations include the removal of 28 months of support at $250 a month, as ordered by Perkins J. (referred to in his oral reasons, at p. 332 of the transcript).

(iii) Interest is 5% a year. It is not compounded.

(iv) Interest is calculated on a monthly basis, beginning March 1, 2000, on the basis of the arrears still owing as of the last day of the previous month.

[6] In the result, paragraph 2 (a) of the Order of Perkins J., dated April 13, 2011, is varied so that the arrears for child support total $27,664.63 instead of $29,000.
