[1] On July 27, 2007 the plaintiff’s motion for leave to appeal from the interlocutory order of Cavarzan J. dated December 6, 2010 was dismissed from the bench. The defendant has made written submissions to costs. The plaintiff has not responded.

[2] The defendant was successful and should have her costs of the motion for leave to appeal on a partial indemnity basis. I fix those costs at $500, all inclusive, and order the plaintiff to pay them forthwith.

[3] An order denying leave to appeal and ordering costs in accordance with paragraph [2] of this endorsement may be taken out by the defendant without approval of the plaintiff.
