[1] This morning the plaintiff’s motion for leave to appeal was dismissed from the bench. The question of costs was reserved until after another motion in the action had been decided. Having heard that motion, I now direct that the parties may make written submissions to the costs of the motion for leave to appeal and the defendant’s motion to dismiss the action.
[2] The materials shall not exceed three pages in length, plus a bill of costs and offer to settle, if any. That is three pages in total for submissions to costs of this motion and the motion for leave to appeal. The defendant’s materials shall be filed by September 2 next. The plaintiff’s materials shall be filed by September 18.
