Reasons for Decision

1The appellant Hui Shang appeals from the Order of Kaufman J. of the Superior Court of Justice, Family Court dated March 19, 2024. The Order flowed from a settlement conference and resolved various legal issues in accordance with Minutes of Settlement signed by the parties.

2The appellant has brought his appeal in the wrong court. Section 19(1) of the Courts of Justice Act, R.S.O. 1990, c. C.43 provides:

An appeal lies to the Divisional Court from…

(a.1) a final order of a judge of the Family Court made only under a provision of an Act or regulation of Ontario.

3Justice Kaufman’s Order was made pursuant to the provincial Family Law Act, R.S.O. 1990, c. F.3. Accordingly, any appeal of that Order must be taken to the Divisional Court.

4The appeal is quashed.
