REASONS FOR DECISION
[1] In our view Justice Koehnen correctly decided the issues before him. We are not persuaded by any of the appellant’s submissions that he erred in any way. The appeal is dismissed. We order that the appellant pay the respondent costs in the amount of $3,000, inclusive of disbursements and H.S.T.
