1The appellant has not complied with the Rules despite several indulgences. He has all but ignored court orders including orders of this court. He has also shown a willingness on at least one occasion to misuse the processes of the court.
2In all the circumstances, we see no reason to interfere with the order dismissing the action. The appeal is dismissed.
3The respondent, Energy Advantage Inc. should have its costs of the appeal and related motion in the amount of $10,000 inclusive of GST and disbursements.
