DOCKET: C39283
COURT OF APPEAL FOR ONTARIO
RE:
HER MAJESTY THE QUEEN (Respondent) v. JOSEPH WATSON (Appellant)
BEFORE:
O'CONNOR A.C.J.O., WEILER and ABELLA JJ.A.
COUNSEL:
Constance Baran-Gerez for the appellant
Joan Barrett for the respondent
HEARD & ENDORSED:
July 4, 2003
On appeal from the conviction entered and the sentence imposed by Justice M. Masse dated June 27, 2002.
APPEAL BOOK ENDORSEMENT
1We did not call upon the Crown on the conviction appeal as we are of the view that the appellant does not meet the requirements for setting aside a guilty plea set out in R. v. Adgey (1973), 13 C.C.C. (2d) 177 (S.C.C.).
2We are satisfied that the sentence of 11 months was fit.
3The appeals from conviction and sentence are, therefore, dismissed.
