1Following the release of our decision in this matter, we received further submissions on costs. We are not persuaded by either party’s argument on costs. In our view, it is appropriate in the circumstances that the costs of the application for leave, the motion for leave to appeal, and the appeal be awarded to SOCAN in the cause and we so order.
