The applicants, citizens of Bangladesh, sought judicial review of a RAD decision confirming the refusal of their refugee claims under sections 96 and 97 of the IRPA.
The RAD found they had viable internal flight alternatives (IFAs) in Dhaka, Khulna, and Chittagong.
Although the RAD accepted that the applicants faced extortion in Sylhet from a local Imam, it found they had not established a serious possibility of persecution in the IFA locations because neither the Imam nor the Jamaat network was motivated to pursue them across Bangladesh.
The Federal Court found the RAD's decision reasonable, noting it comprehensively and logically explained the adverse motivation finding, and dismissed the application.
